The man accused in a deadly shooting and robbery at the Xerox Federal Credit Union in Webster will appear in court on Wednesday.

Richard Wilbern was arrested and charged last month with the murder of Raymond Batzel, who was at the credit union that day. The detention hearing on Wednesday will determine Wilbern’s custody status. For now he is in the Monroe County Jail. We'll also be looking to see if prosecutors indicate whether or not they intend on pursuing the death penalty. They tell us they do have that option.

In court two weeks ago, prosecutors told the judge that they made a request for expedited review of the case by the department of justice. Ultimately the U.S. Attorney General has the final say on whether the case will be pursued as a death penalty case.

The hearing is scheduled for 1 p.m. Wednesday afternoon.
